UpRiver Education, LLC (“UpRiver Education,” “UpRiver,” “we,” “us,” or “our”) is committed to protecting the privacy and security of the educators, schools, districts, and organizations we serve.

This Privacy Policy describes how we collect, use, disclose, and protect information through the UpRiver Education website, UpRiver Learning professional learning platform, and related online services (collectively, the “Services”).

UpRiver Learning is a professional learning platform designed for educators and other adult professionals. It is not a student-facing platform, students do not create UpRiver Learning accounts, and UpRiver Education does not require or intentionally collect personally identifiable student information to provide the Services.

1. Information We Collect

Educator and User Information

 

We may collect information that educators and other adult users provide when they:

• Create or use an UpRiver Learning account;

• Register for professional learning, courses, webinars, or events;

• Participate in UpRiver Learning communities, discussions, or learning activities;

• Complete forms, surveys, or professional learning activities;

• Purchase or register for services;

• Request support or communicate with UpRiver Education; or

• Subscribe to newsletters or other communications.

 

Depending on the Service, this information may include:

• Name;

• Email address;

• School, district, organization, or employer;

• Professional role or job title;

• Account and registration information;

• Professional learning participation and completion information;

• Content or responses voluntarily submitted through professional learning activities;

• Communications with UpRiver Education; and

• Other information users choose to provide.

 

We may also automatically collect limited technical information associated with use of our websites and Services, such as IP address, browser type, device information, operating system, pages visited, and general usage information.

2. Student Data

 

UpRiver Learning is intended for staff professional learning only.

 

Students do not create accounts or directly access UpRiver Learning as users. UpRiver Education does not require schools, districts, organizations, or educators to provide personally identifiable student information in order to use UpRiver Learning.

 

Users should not upload, post, submit, or otherwise provide personally identifiable student information through UpRiver Learning, including student education records, identifiable student work, assessment reports, individualized education programs (IEPs), student identification numbers, or other information that could reasonably identify an individual student.

 

Educators may discuss instructional practices, classroom situations, student learning needs, or examples as part of professional learning, but such information should be de-identified and should not contain information that identifies an individual student.

 

If UpRiver Education becomes aware that personally identifiable student information has been inadvertently submitted to the Services, we will take reasonable steps to address and, where appropriate, delete the information.

 

If UpRiver Education’s Services change in the future in a manner that requires the collection or processing of Student Data, we will update our privacy practices and applicable agreements before implementing that use.

3. School and District Accounts

 

Schools, districts, educational agencies, and other organizations may purchase or provide access to UpRiver Learning for their employees.

 

When an organization provides access to UpRiver Learning, UpRiver Education may receive information necessary to establish, administer, support, and report on staff participation in professional learning. This may include educator names, professional email addresses, roles, organizations, enrollment information, participation, course completion, professional learning hours, certificates or other records of professional learning.

 

This information relates to the professional users of the Services and is not Student Data.

UpRiver Education uses information provided by educational institutions only for legitimate purposes associated with providing, administering, supporting, improving, and reporting on the professional learning Services and as otherwise permitted by applicable agreements and law.

4. How We Use Information

 

We may use information collected through the Services to:

​

• Create and manage user accounts;

• Provide professional learning programs and resources;

• Enroll users in courses, learning paths, cohorts, events, or other professional learning opportunities;

• Maintain records of professional learning participation and completion;

• Provide certificates, learning records, badges, or other recognition of professional learning;

• Provide schools and districts with information about the participation and completion of their authorized users;

• Process registrations, purchases, and transactions;

• Operate, maintain, secure, and improve the Services;

• Respond to questions and provide customer support;

• Communicate about Services, programs, events, and updates;

• Send marketing communications when permitted and allow recipients to opt out of those communications;

• Analyze use of our Services to improve professional learning offerings; and

• Comply with applicable legal and contractual obligations.
   

5. How We Share Information

 

UpRiver Education does not sell personal information or Student Data.

 

We may share personal information only as reasonably necessary to operate and provide our Services, including with:

• Service Providers and Subprocessors. We may use trusted third-party providers to support functions such as website and platform hosting, payment processing, email communications, registration, analytics, customer support, and other business operations. These providers may access information only as necessary to perform services on our behalf and are expected to handle information appropriately and securely.

• Schools, Districts, and Organizations. When an organization sponsors or provides a user’s access to professional learning, we may provide that organization with appropriate information about its users’ enrollment, participation, completion, professional learning hours, or related activity.

• Legal Requirements. We may disclose information when required by law, legal process, or governmental request, or when reasonably necessary to protect the rights, security, or safety of UpRiver Education, our users, or others.
   

We do not use Student Data for advertising, marketing, behavioral profiling, or commercial purposes because our Services are not designed to collect Student Data.

6. Third-Party Service Providers

 

UpRiver Education uses third-party technology and service providers to operate its websites, professional learning platform, communications, payment systems, and related Services.

​

We evaluate the services we use with consideration for privacy and security and limit access to information to what is reasonably necessary for those providers to perform their functions.

​

UpRiver Education may maintain additional information about relevant service providers or subprocessors and make that information available to educational institutions upon request.

7. Data Security

 

UpRiver Education uses reasonable administrative, organizational, and technical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or misuse.

No method of electronic transmission or storage can be guaranteed to be completely secure. Accordingly, while we take reasonable steps to protect information, we cannot guarantee absolute security.

 

If UpRiver Education becomes aware of a security incident involving information subject to contractual or legal notification requirements, we will respond and provide notification as required by applicable law and applicable agreements.

8. Data Retention and Deletion

 

UpRiver Education retains personal information for as long as reasonably necessary to provide the Services, maintain appropriate professional learning and business records, comply with contractual or legal obligations, resolve disputes, and enforce agreements.

Users or authorized educational institutions may contact UpRiver Education regarding access to, correction of, or deletion of personal information.

​

When an organizational relationship ends, UpRiver Education will handle information associated with that relationship in accordance with applicable contractual requirements, legal obligations, and established retention practices.

​

Because UpRiver Learning is not designed to collect Student Data, Student Data should not ordinarily require retention or deletion through the platform. If identifiable Student Data is inadvertently submitted, UpRiver Education may work with the submitting user or educational institution to appropriately address or delete that information.

9. Cookies and Similar Technologies

 

Our websites and Services may use cookies and similar technologies to support functionality, maintain user sessions, understand website and platform usage, and improve the user experience.

Users may be able to control cookies through their browser settings. Disabling certain cookies may affect the functionality of the Services.

10. Children’s Privacy

 

UpRiver Learning is designed for educators and other adult professionals and is not directed to children.

Students are not intended to create accounts or use UpRiver Learning directly. UpRiver Education does not knowingly solicit or collect personal information directly from children through UpRiver Learning.

If we learn that personal information from a child has been provided directly to us contrary to the intended use of the Services, we will take reasonable steps to address and, where appropriate, delete the information.

11. Educational Institutions and Data Privacy Agreements

 

UpRiver Education works with public schools, school districts, educational agencies, and other educational organizations and recognizes their obligations under federal and state privacy laws and applicable student data privacy requirements.

Because UpRiver Learning is a staff professional learning service, UpRiver Education does not require Student Data to provide the Service. Where applicable, UpRiver Education may enter into a Data Privacy Agreement or National Data Privacy Agreement (“DPA” or “NDPA”) with an educational institution.

​

If UpRiver Education enters into a DPA or NDPA with an educational institution, information covered by that agreement will be handled in accordance with the agreement. If there is a conflict between this Privacy Policy and an executed DPA or NDPA concerning information governed by that agreement, the terms of the executed DPA or NDPA will control.

​

Nothing in this Privacy Policy is intended to expand the categories of information that an educational institution is authorized or expected to provide to UpRiver Education.

12. FERPA and COPPA

 

UpRiver Learning is not designed to require disclosure of student education records or personally identifiable Student Data.

​

Because students do not create UpRiver Learning accounts and the Service is intended for professional learning by educators and other adult professionals, UpRiver Education does not rely on schools to provide consent for routine collection of children’s personal information through the platform.

​

Educational institutions and users remain responsible for ensuring that information they choose to provide through the Services is provided in accordance with their own legal, professional, and institutional obligations.

13. Your Privacy Choices and Rights

 

Depending on applicable law and the circumstances of your use of the Services, you may have rights regarding your personal information, including the ability to:

• Request access to personal information we maintain about you;

• Request correction of inaccurate information;

• Request deletion of certain personal information;

• Request information about how your information is used; or

• Opt out of marketing communications.
   

Certain information may need to be retained for legitimate business, contractual, professional learning recordkeeping, or legal purposes.

Our Services may contain links to third-party websites, resources, or services. UpRiver Education is not responsible for the privacy practices of third-party websites or services that operate independently from UpRiver Education. Users should review the privacy practices of those services when appropriate.

15. Changes to This Privacy Policy

 

We may update this Privacy Policy periodically to reflect changes to our Services, technology, legal requirements, or privacy practices.

When we make changes, we will update the “Last Updated” date above. If changes materially affect how we handle personal information, we will provide additional notice when appropriate.

​

We will not materially change our practices regarding information governed by an existing DPA or NDPA in a manner inconsistent with that agreement while the agreement remains in effect.
